8 - Informed customer consent, risk management related to anesthesia, restraint and medical care:
Any procedure performed on an animal (medication, anaesthesia, surgery) involves risks, which we inform the owner of. This information is usually given verbally, but may also be provided in writing (in the form of a care contract) in special and/or serious cases where the animal's life is at stake. Physical or chemical restraint may be necessary to implement care during a consultation. Despite all precautions, this may result in injury to the patient. We will inform the owner of the need to use a particular type of restraint, where appropriate, for reasons of safety for both the animal and the care team.
9 - Quotation/Care contract:
As soon as an animal is entrusted to us, a care contract is established, either tacitly or in writing, which implies that the service provider will provide the necessary resources to care for the animal, and that the owner will pay the fees when the animal is returned. A written estimate can be drawn up at the owner's request, after clinical examination of the animal and diagnosis of the condition. Estimates are subject to change. Estimates are valid for one month from the date of issue. All estimates/contracts accepted and signed by the owner commit the latter to paying on the day the treatment is completed.
10- Terms and conditions of payment:
Full prices are available on request. The total to be paid corresponds to the sum of medical and surgical services and will give rise to a detailed invoice in accordance with legislation.
Fees are payable in cash on completion of treatment, return of the animal or at the end of the consultation by credit card or cash. No credit is granted. The service provider reserves the right to demand payment in advance or in full at the outset of the treatment contract (verbal or written). Whatever the method of payment agreed between the parties, payment will only be deemed to have been made once the full price has been received. In the event of non-payment, the seller reserves the right to terminate the contract of care or to suspend the performance of current and future services in accordance with Art R242-48 of the French Rural Code.
PENAL CLAUSE
In accordance with article L441-6 of the French Commercial Code, late payment penalties apply in the event that the sums due are paid after the payment date shown on the invoice. These late payment penalties are calculated on the basis of 3 times the legal rate and will give rise to a minimum collection fee of €50. Should the purchaser's failure to pay render a contentious recovery procedure necessary, the customer undertakes to pay, in addition to the principal, costs, expenses and emoluments ordinarily and legally payable by him, an indemnity fixed at 35% of the principal amount of the debt, inclusive of tax.
ACCELERATION CLAUSE
In the event of total or partial non-payment of a service or order on the due date, the sums due for this service/order or for other orders already carried out or in progress will become immediately payable after formal notice.
RESOLUTORY CLAUSE
All requests for services are accepted in consideration of the purchaser's legal, financial and economic situation at the time of the request for service. As a result, should the buyer's financial situation deteriorate between the date of the request and the date of performance of the service, the seller is entitled either to demand payment before the service is rendered, or to refuse the service. In the event of non-performance of any of the present conditions, the service provider will send the debtor formal notice by registered letter with acknowledgement of receipt. Should the purchaser fail to fulfil his obligation within fifteen days of the sending of this formal notice, the service provider will refuse any new request for service in accordance with art. R242- 48 paragraph VI of the French Rural Code. Home Vet Care will systematically take legal action in the event of non-payment of fees due.
